Terms and Conditions (GTC)
1. Validity of the terms and conditions and conclusion of contract
1.1 These general terms and conditions (GTC) apply to sales contracts with private customers and/or companies that are concluded via the website of the provider.
1.2 The order is confirmed by the provider. The contract is concluded as soon as the confirmation arrives at the buyer. If the confirmation does not occur within a reasonable period of time, the buyer considers this as a rejection of the order and is entitled to conclude the contract with another supplier.
2. Prices and special offers
2.1 Prices are quoted in CHF or Euros. Included are the early recycling fee and processing. VAT and shipping costs (postage and packaging) will be charged extra and shown separately.
2.2 The provider reserves the right to change prices at any time. For the customers, the prices published on the website on the order date apply.
2.3 The conditions for any actions and discounts are available on the relevant information.
3. Delivery conditions
3.1 Delivery to Switzerland normally takes place within 3 working days. Deliveries to EU countries can take up to 10 days. If a longer delivery period is necessary, the customer will be informed at the latest after this time has expired. If no information is given, the customer is entitled to waive the delivery.
4. Right of withdrawal
4.1 If a customer withdraws from the purchase because of late delivery or defects in the goods or other reasons for which the provider is responsible, the provider refunds already paid amounts and the return costs.
5. Liability and warranty
5.1 The supplier guarantees for a period of 24 months that the goods have the warranted characteristics, that they have no defects that are detrimental to their value or suitability for the intended use and that they comply with the prescribed services and specifications. The invoice is considered a receipt and guarantee certificate, the invoice date as the beginning of the guarantee period.
5.2 The warranty does not cover the effects of normal wear and tear or improper use.
5.3 The buyer must check the delivered goods as soon as possible and report any defects immediately. Defective products must be returned to the manufacturer at their own expense. After examination of the defect / cause and determination of a defect on the part of the manufacturer, the product will be replaced free of charge. Secret defects can still be objected to after commissioning or use of the goods. The payment of payments does not constitute a waiver of notice of defects.
6. Payment
6.1 Payment is possible at the request of the customer in the following ways:
By advance invoice. The delivery of the goods takes place after receipt of payment.
By credit card (only possible in the online shop). All major credit cards are accepted.
7. Liability for online connections
7.1 The provider undertakes to provide the latest state-of-the-art security in systems, programs, etc. that belong to him and over which he has an influence, as well as to follow the rules of data protection.
7.2 The provider is not liable for defects and malfunctions that he is not responsible for, especially not for safety defects and operational failures of third party companies, with whom he collaborates or on which he is dependent.
7.3 Furthermore, the provider is not liable for force majeure, improper action and neglect of the risks on the part of the customer or third parties, excessive use, inappropriate equipment of the customer or third party, extreme environmental influences, interference by the customer or interference by third parties (viruses, worms, etc.), which happen despite the necessary current security measures.
8. Application of law and jurisdiction
8.1 Private customers in Switzerland:
For claims from a customer, the court of jurisdiction is the domicile or seat of one of the parties. For complaints from the provider, the court at the domicile of the defendant party is responsible.
Business customers in Switzerland:
These terms and conditions are subject to Swiss law, namely the regulations of the OR. Jurisdiction is CH-4600 Olten.
8.2 Private customers abroad:
For foreign customers, the courts at the domicile of the customer or at the domicile of the provider are at his discretion. For a claim from the supplier against the customer, the courts at the domicile of the customer are responsible.
Business customers abroad:
For these terms and conditions, Swiss law applies, namely the regulations of the OR. Jurisdiction is CH-4600 Olten.
